Preamble

Figaro Classifieds, a SAS with capital of €6,974,118, headquartered at 9 rue de Caumartin, 75009 Paris, registered with the Paris Trade and Companies Register under number 431 373 471 (hereinafter referred to as "Figaro Classifieds"), operates the website https://properties.lefigaro.com/ (hereinafter referred to as the "Site") as well as a mobile application (hereinafter referred to as the "Application"), providing access to various information, services, and additional products detailed below.

These general terms of use ("GTU"), governed by French law, regulate the use of the Site and the Application, as well as the use of various free services (hereinafter the "Service(s)"). Browsing the Site/Application and/or registering on the Site/Application constitutes express and unconditional acceptance of the GTU by the user of the Site.

In case of non-compliance with the terms of these GTU, Figaro Classifieds reserves the right to take any measures necessary to protect its interests, including enforcement. Figaro Classifieds may, in particular, hold the user of the Site/Application (hereinafter the "User") liable in civil and/or criminal proceedings. Any conflicting condition and/or provision not accepted by Figaro Classifieds shall be unenforceable against it. The fact that Figaro Classifieds does not enforce a provision of these GTU shall not be construed as a waiver of its right to enforce it later.

Article 1 - Definitions

For the purposes of these GTU, the following terms in uppercase have the following meanings:

• Account: The space available to the User registered on the Site/Application, allowing them to access, after logging in with their access credentials, the subscribed Services as well as their personal space.
• Application: The interactive electronic service operated by Figaro Classifieds, accessible from any device with an internet connection, available for free download on the App Store (iOS devices) or Google Play (Android devices), or via a web browser, enabling access to the Services.
• Content: All information and publications accessible on the Site/Application, including its general structure, texts, numerical data, graphics and tables, animated or static images, videos, sounds, hyperlinks, trademarks, and logos constituting its graphical charter, as well as associated databases.
• Form: The registration form allowing the User to sign up for some or all of Figaro Classifieds' free Services.
• Site: The set of Content and Services offered by Figaro Classifieds on the website accessible at https://properties.lefigaro.com/, regardless of the page concerned.
• Services: All free services accessible via the Site and/or the Application.
• User: Any registered user or visitor browsing the Site and/or the Application strictly for private use.

Article 2 - Presentation of the Site/Application and Description of Services

2.1. General Provisions

The Services offered on the Site and/or the Application by Figaro Classifieds facilitate the User's search for purchasing, selling, and/or renting real estate by providing access to the Services defined below. A registered User on the Site and/or the Application may have a personal space or an Account. However, the Site/Application is not designed for content storage, and it is the User's responsibility to take necessary measures for this purpose.

To access the Site/Application and use the offered Services, the User must have an internet connection and a computer, smartphone, or digital tablet.

The User acknowledges that before using the Services, they have ensured that their IT equipment and internet connection meet technical requirements, do not contain viruses, and function properly. The User is responsible for protecting their own data and software from potential internet-transmitted viruses.

The equipment (computers, tablets, software, telecommunications means, etc.) enabling access and use of the Site/Application and the Services is entirely at the User’s expense and responsibility, including any related telecommunications costs.

The User is informed that free access to Content and Services on the Site/Application is funded by advertising revenue displayed on these platforms. Therefore, they accept the display of advertisements on the Site/Application.

As the publisher of the Site/Application, Figaro Classifieds is free to commercialize advertising space with advertisers of its choice. The User acknowledges having no rights to these advertising spaces and waives any claims in this regard.

2.2. Services

Figaro Classifieds offers the following Services to the User:

• Consultation of Content and information on the Site/Application for searching and viewing property sale and/or rental listings (new or old properties) in France, access to informational content about the real estate market, consultation of advisory articles on best real estate practices.
• Consultation of price-trend barometers tracking price per square meter by property type and transaction across France, by region, city, district, and street.
• Subscription to a real estate newsletter
• Subscription to daily email alerts containing real estate listings relevant to the User's search criteria.
• Price estimation for the User’s property.
• Subscription to certain publications from Figaro Classifieds’ third-party partners ("Partners"), subject to the User’s prior consent.
• Saving selected property listings as favorites without creating an Account.
• Access to different Services, subject to prior registration, allowing the User to:
  1. View and manage saved alerts via their User Account.
  2. View and manage saved favorites via their User Account.
  3. Manage subscriptions, including receiving Partner offers selected by the Site/Application.
  4. Modify the information stored in their User Account (email, password, etc.).

Article 3 - Account Creation

To access certain Services, such as daily real estate alert emails related to the User’s search criteria, the User must create an Account via the online registration Form.

• Account creation is intended for adults but is also available to minors under adult supervision. Figaro Classifieds cannot be held responsible for the unintentional collection of personal data from minors.

By registering, the User guarantees that they provide accurate and up-to-date information, particularly concerning their identity and contact details. They must provide a functional email address that they own. Figaro Classifieds reserves the right to refuse a registration, suspend, or close an account if there are doubts about the provided information and/or if the User fails to comply with these GTU.

The use of the Site/Application and its associated free Services following registration is valid indefinitely.
The User must immediately inform Figaro Classifieds of any unauthorized use of their Account or any security breach by contacting [email protected] or writing to: Figaro Classifieds Propriétés le Figaro service DPO, 9 rue de Caumartin, 75009 Paris.

The User is free to modify their personal data at any time. Upon validating the Form, the User receives an email invitation to click on a link to confirm their registration. Account access is secured by the User’s email and password, which they are solely responsible for keeping confidential.

Figaro Classifieds reserves the right to terminate an Account at any time with reasonable notice via email. In the event of GTU violations, an Account may be immediately and permanently disabled without notice.

The User can deactivate their Account at any time by following these steps:

1. Visit https://properties.lefigaro.com/ and click the login icon in the top-right corner.
2. Log in using personal credentials.
3. Go to the "Edit my profile" section.
4. Click "Delete my account."

Deactivating an Account restricts access to Services, allowing the User only to access freely available Site/Application Services.

The User will therefore no longer be able to access the following Service: registration (free Service) for email alerts sent every day containing only property advertisements related to the search and registration details of the Internet user.

Article 4 - Newsletter Subscription

Figaro Classifieds offers Users and all internet visitors of its Site/Application a newsletter subscription service.

Subscribing to this service allows Users to receive Figaro Classifieds' newsletters (articles and advice sheets) periodically via email free of charge.

To benefit from this Service, the User must enter their email address in the subscription block.

The User may unsubscribe at any time:

• By clicking the unsubscribe link included in each newsletter;
• Or by writing directly to Figaro Classifieds at: [email protected]

Article 5 - Subscription to Partner Content

When completing the contact form linked to a real estate listing on the Site/Application, allowing the User to be contacted by the advertising Partner, Figaro Classifieds offers Users the option to subscribe to Partners publications

Subscribing to this service allows Users to receive publications from Partners under the conditions they define.

Subscription to this service requires the User’s prior consent at the time of sending their contact request for a real estate listing published on the Site/Application.

Once registration is confirmed, Partners act solely as service providers responsible for managing the service and processing the data of the subscribed User. To exercise their rights (including unsubscribing), the User must contact the Partners directly.

Article 6 - Intellectual Property Rights of the Site/Application

The User is prohibited from reproducing and/or using trademarks and logos present on the Site/Application and from modifying, copying, translating, reproducing, selling, publishing, exploiting, or distributing, in any format, any part of the information, texts, slogans, graphics, photos, images, videos, and data on the Site/Application, which constitute works as defined under Article L112-1 of the French Intellectual Property Code.

The User acknowledges that the Site/Application and Services consist of multiple databases made available by Figaro Classifieds as the producer of such databases under Articles L.341-1 and following of the French Intellectual Property Code. Therefore, the User is also prohibited from extracting, storing, reproducing, displaying, or otherwise using substantial qualitative or quantitative portions of any databases from the Site/Application.

Violation of these provisions exposes offenders to civil and criminal penalties as provided by law.

Furthermore, the User is prohibited from collecting, storing, using, extracting, or automatically reproducing any Site content using robots, software, or any other automated means for commercial purposes, particularly for training artificial intelligence software.
To prevent unauthorized use, Figaro Classifieds reserves the right to implement protective measures on the Site, including technical blocking measures.

Figaro Classifieds and/or its partners hold exclusive rights to the name, logo, trademarks, structure, layout, databases, and Content of the Site/Application worldwide.

Figaro Classifieds grants Users a private, non-collective, and non-exclusive right to use its Content. This right is limited to printing articles and/or saving them to a personal device (computer, mobile, or tablet) for personal use only. Any networking, redistribution, professional or commercial use, or resale of the Content to third parties, in any form, is strictly prohibited without prior authorization from Figaro Classifieds. The same applies to RSS feeds and newsletters. Those wishing to use any part of the Content for professional or commercial purposes, particularly RSS feeds, must contact Figaro Classifieds at [email protected]

Article 7 - User Responsibility

General Responsibility in the Use of the Site/Application and Available Information

The User accesses and uses the Site/Application and its Services at their own risk and under their sole responsibility. Figaro Classifieds does not guarantee that the Site/Application and its Services will be uninterrupted. The obligation to provide the Site/Application and its Services is limited to a best-effort obligation.

The Content and other data displayed on the Site/Application are not intended as advice upon which Users or visitors should make decisions. Figaro Classifieds disclaims any liability for reliance placed by Users or any third parties on the information provided. The User should not assume that the Content is accurate or up to date and must independently verify all information.

Figaro Classifieds and its Partners shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages resulting from errors, omissions, or transmission delays of information on the Site/Application. Likewise, any information obtained from the Site/Application or through Services offered by Figaro Classifieds, whether via the Site/Application, email, or text message, is provided without warranty.

The photographs and descriptions of products presented on the Site/Application are not contractual. Consequently, Figaro Classifieds cannot be held responsible for errors in any of these photographs or descriptions

The Content offered on the Site/Application complies with applicable French law. Figaro Classifieds cannot be held liable for non-compliance with the laws of the User's country of access.

Figaro Classifieds warns parents about the diversity of online content, which may be inappropriate or harmful to minors. Parents are encouraged to supervise their children’s internet use.

Article 8 - Site/Application Availability

The Site is generally accessible 24/7, except for scheduled or unscheduled maintenance or force majeure events. Figaro Classifieds is not responsible for any damage or malfunction related to the User’s computer or internet connection resulting from Site/Application unavailability or the presence of viruses.

Figaro Classifieds does not guarantee:

• The speed of access to the Site/Application or buffering speed.
• The quality of text, information, descriptions, photographs, or videos published on the Site/Application.

Article 9 - Force majeure

Figaro Classifieds shall not be liable if the execution of any of its obligations is prevented or delayed due to force majeure as defined by article 1218 of the Civil Code as amended by order no. 2016-131 of 10 February 2016 and interpreted by the case law of the French Courts. This includes, but is not limited to, natural disasters, fires, telecommunication or electrical network failures, or disruptions.

Article 10 - Hyperlinks

The Site/Application may contain information provided by third-party companies or hyperlinks to external websites not developed by Figaro Classifieds. The presence of such links does not constitute approval of the sites or their content. Users should exercise discretion when using this information. Figaro Classifieds assumes no responsibility for third-party opinions, recommendations, or website content.

Figaro Classifieds has no control over these external sites, their products, or services and is not responsible for their availability or content. If an external page linked to the Site/Application contains illegal content, Figaro Classifieds will remove the link upon notification.

Article 11 - Proof, Retention, and Archiving

Computerized records maintained in secure systems will be considered proof of email communications, Form submissions, Content downloads, and publications. Registration Forms will be archived on secure media for the legally required duration, as per Decree No. 2011-219 of February 25, 2011 on data retention.

Article 12 - Confidentiality and Personal Data

Figaro Classifieds processes User personal data to provide the subscribed Services. The details of personal data collection, processing, and retention are outlined in the Site/Application’s Privacy Policy. du Site/Application

Figaro Classifieds ensures data security and confidentiality in compliance with personal data protection regulations. Personal data is collected legally and fairly within the framework of Site/Application usage and Service provision.

Article 13 - Autonomy of GTU Clauses

If any provision of these GTU is deemed unenforceable under applicable law, the User and Figaro Classifieds will renegotiate in good faith to maintain their economic position as closely as possible to the original provision. If no agreement is reached, the invalid provision will be removed, and the remaining GTU will remain in effect.

Article 14 - Modification des CG

Figaro Classifieds reserves the right to modify these GTU at any time. Users will be informed of updates via online modifications.

For inquiries or complaints regarding the Services, Users can contact Figaro Classifieds: In the event of requests or complaints from the User relating to the Services subscribed to and/or offered on the Site/Application, for which the User does not find sufficient information and/or answers in these General Conditions of Use, or any other documentation accessible on the Site/Application, Figaro Classifieds may be contacted:

Article 16 - Applicable Law and Jurisdiction

These GTU are governed by French law. In case of disputes, French courts shall have exclusive jurisdiction.
