1.PURPOSE AND ACCEPTANCE

The purpose of these general conditions of use (hereinafter the "GCU") is to define the terms and conditions of consultation and use of this website (hereinafter the "Site") published by FIGARO CLASSIFIEDS (hereinafter "FIGARO CLASSIFIEDS"). The simple fact of consulting or using the Site, shall be understood as acceptance, without reserve on behalf of the Internet user reading the present CGU.

2. BEHAVIOUR TO BE RESPECTED BY THE INTERNET USER

• The Internet user undertakes to navigate on the Site while respecting the instructions which appear on their screen.
• The Internet user is prohibited from making any use of the Site and the services offered on the Site that contravenes the regulations in force, and more generally that would harm the interests, reputation or image of FIGARO CLASSIFIEDS.
• As a consequence, the Internet user shall in no way in particular:
  
  • use any devices whatsoever in order to disrupt and/or hinder the proper functioning of the Site and the services published on the Site;
  • disseminate or send contents, in any form whatsoever, relating, in particular, to xenophobia, racism, incitement to racial hatred, paedophilia, pornography, calls for murder, defamation, insult, or infringing the rights of third parties, including intellectual property rights and the right to privacy;
  • send unsolicited e-mails in an abusive manner (mass and/or repeated sending to one or more recipients);
  • and more generally collect the personal information published on the Site for the purposes, in particular, of commercial prospecting. The authors of the ads cannot be contacted for reasons other than the subject of their ads by any means whatsoever.

3.LIABILITY OF FIGARO CLASSIFIEDS

FIGARO CLASSIFIEDS takes great care in setting up and updating the Site and in particular the advertisements. However, as FIGARO CLASSIFIEDS does not have control over all the data and information published on the Site, it does not guarantee that it is accurate, error-free or complete, or that it perfectly meets your expectations. Consequently, FIGARO CLASSIFIEDS shall not be held liable for any damage that may result, and more generally for any use of the Site and/or its contents.

FIGARO CLASSIFIEDS reserves the right, at any time, to modify, suspend or interrupt, temporarily or permanently, all or part of the Site without prior notice. FIGARO CLASSIFIEDS shall not be held liable, with regard to the user or any third party, for any modification, suspension, interruption of the Site, or alterations to access to the Site and the services published on the Site, for any reason whatsoever.

FIGARO CLASSIFIEDS urges any user to report any problem or content appearing illicit, offensive or not in conformity with morality by using the functions provided for this purpose on the Site. In such cases, FIGARO CLASSIFIEDS may take any action it deems necessary in the event of unauthorised or illegal use of its Site.

Finally, you expressly acknowledge and agree that FIGARO CLASSIFIEDS shall not be liable for any damage resulting from any relationship of any kind whatsoever between you and an advertiser or any other partner providing content or services on the Site. In this case, you may only seek the responsibility of the author or third-party partner.

4. INTELLECTUAL PROPERTY

FIGARO CLASSIFIEDS implements legal and technical measures to protect intellectual property rights.

FIGARO CLASSIFIEDS therefore undertakes:

• to inform its users of their obligations regarding the exploitation of protected content;
• to contribute to the action of the relevant authorities in the fight against counterfeiting, at their request.

FIGARO CLASSIFIEDS holds the rights concerning certain data protected by the Intellectual Property Code. This is notably the case for all its brands, its graphic charter and its database. Consequently, their offline or online use, free of charge or against payment, of all or part of these data without the express consent of FIGARO CLASSIFIEDS is prohibited.

Consequently, the Internet user shall in no way:

• reproduce, represent, use, distribute, by any means and in any form and medium whatsoever, the Site, and any constituting element of the Site (text, photo, image, video, sound, software, trademark, logo, corporate name, or any other distinctive sign, etc.), except for strictly private purposes, subject to retaining on printed copies all copyright notices and any other legal notice appearing on the originals;
• extract by permanent or temporary transfer, or reuse by making available to the public, all or a qualitatively or quantitatively substantial part of the advertisements and other databases present on the Site, as well as make an extraction or reuse, repeatedly and systematically, of qualitatively or quantitatively non-substantial parts, when these operations clearly exceed the conditions of normal use;
• exploit, market, distribute for the benefit of third parties, in any form whatsoever, the Site, any constituting element thereof, advertisements and other databases present on the Site;
• modify, remove, alter, by whatever means and in whatever form and medium, all or part of the various intellectual property and copyright notices appearing on the Site.

Any use not in accordance with the above provisions is illegal and will lead to prosecution.

• inciting discrimination, hatred;
• pornographic or paedophile;
• inciting the commitment of a crime, an offence or an act of terrorism or advocating war crimes or crimes against humanity.

7. HYPERTEXT LINKS TO OTHER SITES

The Site contains hypertext links to websites published by third parties. The inclusion of such links does not imply endorsement by FIGARO CLASSIFIEDS of the content of such sites. FIGARO CLASSIFIEDS cannot permanently control the content of these sites, and therefore cannot guarantee:

• the accuracy, reliability, relevance, currency, or completeness of their content;
• their access and good technical performance.

Consequently, FIGARO CLASSIFIEDS shall not be held liable in the event of any dispute between a merchant site referenced on the Site and a user. Only the editors of the commercial sites referenced on the Site may be held liable.

FIGARO CLASSIFIEDS undertakes to take all legal and technical measures to secure exchanges. As such, FIGARO CLASSIFIEDS is committed to an obligation of means to block data misuse, and to comply with applicable regulations.

Nevertheless, with regard to the technical characteristics of the Internet network, the user acknowledges that the reliability of data transmissions over the Internet network is relative, particularly given the heterogeneous nature of the network.
